Terms of Services.

Note : These Terms can change over time please ! It is not my responsibility if you have not read these terms and the updated terms before commissioning. Thank you to understand.
General Terms.
IMPORTANT TERMS
- If you commissioning me, you are agreeing to these terms.
- You will have to sign an agreement and sign electronically, THIS IS A MANDATORY RULE, this will avoid any conflict and it will prove with your signature that you really agree with the TOS. (ONCE SIGNED THE CONTRACT CANNOT BE CANCELLED)
- Know that I have a disability, so it can sometimes happen that your Commission may be late if my disability creates problems for me at that time (it doesn't happen often but it can happen). Thank you for understanding that I can't do anything about it if it happens.
• You have to credit me if you take a Commercial Use commission Obligatory (@vaelyatelier on Twitter/X), if is a Personnal Use is highly recommanded, thank you to understand.
• Commissions are digital goods, nothing physical will be sent.
• I keep project files on my disk ONLY for month. The client responsibility is to save all commissioned files.
• All your ideas, explanations etc... for your commission must be sent in advance to avoid any ambiguity and conflict.
• I reserve the right to decline any commission for any reason.
• Once delivered, commissions cannot be resold through VaelyAtelier unless agreed upon by client.
• Work in progress can always be requested throughout the process.
• Please provide a clear image, reference or description.
• As the artist I reserve the right to use commissions to self promote. A non-disclosure agreement will incur an additional fee, this must be notified prior to any payments.
• Prices are final and non-negotiable.
• ⚠ A 15% tax will be applied to your orders to offset processing and payment costs of the platform. Thank you to understand.
• If you are an artist like me, I allow you to be inspired by my work. But there are conditions, if you are inspired by my work credit is MANDATORY, so that people know who the inspiration comes from. You will also have to be careful that your work is not identical to mine, I do not authorize PLAGIARISM, if you manage to plagiarize my work I would be obliged to DM you to ask you to delete it necessarily if you do not do this, the problem will go beyond the DMs and procedures will be incurred.
Payment Guideline.
• All payments are made through a Paypal Invoice in €. (But if you prefer you can pay me on Ko-fi there is no problem)
• ⚠ A 15% tax will be applied to your orders to offset processing and payment costs of the platform. Thank you to understand.
• Payment is 100% upfront unless agreed upon by artist and the client.
• I accept payment plans for payments over 170€. With payment plans 50% is required upfront and the remainder 50% is due when the first WIPs are approved.
Copyright & Usage.
All commissions are by default under personal use.
- Personal Use
• Use for monetized content. (Twitch, Youtube, etc.)
• Use on social media. (Twitter, Discord, etc.)
Under personal use the client is encouraged to credit VaelyAtelier by username or any platform handle.
- Commercial Use +150% Additional Fee
• Use for monetized content. (Twitch, Youtube, etc.)
• Use on social media. (Twitter, Discord, etc.)
• Use for merchandise. (Products, Stickers, Tote bag , etc.)
• Use for paid content. (Patreon, Ko-Fi, etc.)
Under commercial use the client is must to credit VaelyAtelier by username or any platform handle.
- Extended Commercial Use +250% Additional Fee
• Use for monetized content. (Twitch, Youtube, etc.)
• Use on social media. (Twitter, Discord, etc.)
• Use for merchandise. (Products, Stickers, Tote bag , etc.)
• Use for paid content. (Patreon, Ko-Fi, etc.)
• Resell commission.
• Redistribute commission.
• Edit commission.
Under commercial use the client is must to credit VaelyAtelier by username or any platform handle.
The client does not reserve the right to redistribute, edit or resell commissions without an extended commercial license provided by VaelyAtelier.
The client does not reserve the right to claim the commission as their own work, even If provided the extended commercial license by VaelyAtelier.
Deadlines & Delivery.
• All files will be delivered via email for a better quality. I highly recommend using email, as if you lose files you can find and download them easily.
• As for “DEADLINE”, it will be difficult for me to give one. If I have a lot of commissions or other things it may take longer.
So from the date of payment I give myself a minimum of 1 month to complete your Order. (Minimum = it can be more or less if I finished it before)
• I will get to your commission once your slot in the queue is reached. Delays may incur by orders with deadlines, any delay affecting a commission the client will be notified.
• Clients can request a deadline :
- 4 to 5 days : +180% of the commission amount
- 6 to 7 days : +95% of the commission amount
- 1 to 1.5 weeks : +65% of the commission amount
Deadline orders must be paid in full upfront.
• Clients can request a non-disclosure agreement for their commission. Process and final commission will be kept private, only shared with the client. An additional price fee will be applied (Private fees : 50€).
Refund Policy.
If you want to commission me, make sure you have the money to do so.
Note that for this type of thing everything must happen in private and not be disclosed publicly. We are adults, conflicts can be resolved amicably and that is my primary goal, I want to avoid huge scales when everything is adjustable.
• Customers are entitled to a refund if the commission is canceled before the commission begins.
• Repeated cancelling will result in a blacklisting. Thank you to understand.
• Refunds are no longer eligible If the commission is cancelled after the commission has started.
All work deserves pay, thank you for understanding that.
• Chargebacks are strictly prohibited. If a customer does this, they will be blacklisted and I will warn other artists I know about this behavior, including your social media handles.
Privacy Statement.
By commissioning me you agree to these statements and will withhold them.
• Both VaelyAtelier and the client are not to disclose, use or make available to any third party the others Confidential Information.
Both parties must hold this Confidential Information securely. Exceptions are:
1. The other party has written permission with conditions involved or
2. If it is required to disclose according to the requirements of any law, legislative or judicial body
• These conditions will remain amongst cancellation or any other agreement.
Commission Process.
- Inquiry
• Go to my services and choose a service you would like to order, then go to my order form fill out the form and submit it or send me a message via Twitter/X, Discord or Email directly.
• Upon receipt of the purchase order, I will review it to determine if I am the right person for your needs. I will respond to you within a few days and let you know whether I accept or decline your request.
• When I accept I will send you a proposal with pricing, a contract to sign which is MANDATORY and an estimated delivery time for you to accept.
• Once the proposal is accepted. I will get your Paypal email and send you an invoice. Once paid, you will be added to my "To-Do List".
- Process
• I will keep you informed on any updates or delays. All will be relayed through the "To-Do List" and direct messages.
• I start working on the ideas and creating the concept. Once this concept is complete, I will contact you for any revisions and approvals to continue. Significant revisions are made during this stage only, be sure to give feedback if you would like something revised.
• Progress will only continue after I get your approval on progress updates. There is no rush to respond to my messages, but please be aware that this may extend the time needed to complete the commission.
• Once the concept is approved, I will continue to work on it and/or submit. I will send you updates on the process from time to time. Only small revisions can still be made at this stage. But if you want major revisions after your approval, this is possible, but it will cost you a price. (Between 5-10€ or more it will depend on the difficulty and of the type of commission)
• You are always able to ask for progress updates but please don't spam me. I have a life like you too and i'm not always on my phone or computer, thank you to understand that please ...
- Delivery
• Once your commission is finalised, I will contact you via your social media to send you the files at your mail. I highly recommend using email, as if you lose files you can download them again and to have it in good quality.
By commissioning me, you are agreeing to these terms.
Any term can be edited if discussed with me prior to the commission.
These Terms can change over time, it is not my responsibility if you have not read these terms and the updated terms before commissioning.
